1. Acceptance of terms

By accessing or using www.zaviagis.com (the “Site”), submitting an inquiry, or engaging Zavia GIS Consulting (“Zavia GIS”, “we”, “our”) for services, you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, please do not use the Site or our services.

2. Services

Zavia GIS provides preliminary desktop screening and GIS mapping support services based on publicly available data, as described in our Scope of Services. Service scope, pricing, deliverables, and turnaround are confirmed in writing for each engagement before work begins.

Zavia GIS does not provide formal Environmental Site Assessments, engineering, legal advice, surveying, planning opinions, regulatory sign-off, or buildable / not-buildable conclusions.

3. Pricing and payment

• Pricing on the Site (e.g., “from $249”) is indicative. Final pricing is confirmed in writing per engagement and depends on property size, location, data availability, and requested deliverables.
• Standard payment terms are net 14 days from invoice date unless otherwise agreed in writing.
• All prices are in Canadian dollars (CAD) and exclusive of applicable taxes.
• Late payments may incur interest at 1.5% per month (18% per annum).

4. Cancellation and refunds

• You may cancel an engagement before work commences with no penalty.
• If work has commenced, you will be invoiced for time and materials reasonably incurred to the point of cancellation.
• Refunds are issued for clear errors on our part. Disagreements with screening conclusions are not, on their own, grounds for refund — our deliverables reflect what the public mapping data shows.

5. Intellectual property

• The Zavia GIS name, logo, brand elements, website design, and content are owned by Zavia GIS Consulting.
• Deliverables prepared for a client are licensed to that client for their own use related to the property or project in scope. Resale or republication for commercial use requires written permission.
• Underlying public GIS data is owned by the originating authorities (Conservation Authorities, MNRF, municipalities, etc.) and remains subject to their respective licences.

6. Limitation of liability

To the maximum extent permitted by law:

• Zavia GIS’s total liability for any claim arising out of or relating to an engagement is limited to the fees paid by the client for that engagement.
• Zavia GIS is not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits or lost business opportunities.
• Zavia GIS is not liable for decisions made by the client or third parties based on screening outputs, where formal professional review was indicated and not obtained.
• Zavia GIS is not liable for inaccuracies, omissions, or changes in publicly available GIS data sources after the date of delivery.

7. Indemnification

You agree to indemnify and hold Zavia GIS Consulting harmless from any claim, loss, or liability arising from your use of our deliverables outside the scope agreed to in writing, your misrepresentation of our outputs to third parties, or your decision to forego recommended professional review.

8. Use of the Site

• You may browse the Site for personal or business research purposes.
• You may not scrape, automate, or systematically extract content from the Site without written permission.
• You may not use the Site to transmit malicious code, attempt unauthorized access, or interfere with its operation.
• Linking to the Site from your own properties is permitted and encouraged.

9. Third-party links and references

The Site may reference or link to third-party organizations (Conservation Authorities, regulatory bodies, software providers). Such references are descriptive only. Zavia GIS does not endorse, and is not affiliated with, any referenced organization unless explicitly stated.

10. Governing law and jurisdiction

These Terms & Conditions are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute will be resolved in the courts of Ontario, Canada.

11. Changes

We may update these Terms & Conditions from time to time. The “Last updated” date at the top reflects the most recent change. Continued use of the Site after changes are posted constitutes acceptance.
